Clearer WTO Rules Ahead: Good News for Importers and Exporters
Effective on January 2, 2026
China’s Ministry of Commerce has released the new Measures for the Implementation of Trade Policy Compliance Work (Announcement No. 60 of 2025). This update creates a clearer, faster, and more structured system to ensure that all Chinese trade-related policies comply with WTO rules.
For companies engaged in import, export, logistics, trade finance, manufacturing, and supply chain operations, this means greater predictability and fewer policy surprises.
Below is what matters most for the business community.
-
All Trade-Related Policies Must Pass a WTO Compliance Check
Before any central or local government department can issue a policy affecting:
- Goods trade
- Services trade
- Trade-related IP
- Foreign investment
they must now conduct a mandatory compliance assessment. If the review finds any possible inconsistencies with WTO rules (meaning a policy might conflict with China’s WTO commitments), the department must revise the policy before it can be submitted or approved.
Why this matters for trading businesses
Fewer sudden regulatory changes, stronger alignment with global trade standards, and a more stable environment for planning shipments, sourcing, contracts, and expansion.
-
Fast Response Mechanism for WTO Concerns
If other WTO members question a Chinese trade policy, then:
- MOFCOM forwards the concern within 5 working days
- The responsible department must reply within 10 days
- MOFCOM issues China’s official response within 15 days
Local governments follow a similar but slightly longer timeline.
Why this matters:
Trade disputes can be clarified and resolved faster, reducing uncertainty for exporters and importers.
-
China Will Also Act Faster When Other Countries Violate WTO Rules
If a Chinese ministry or local government believes another WTO member has issued a discriminatory or non-compliant measure, they can report it to MOFCOM.
MOFCOM will evaluate the issue and raise it at the WTO when necessary
Why this matters:
Better defense mechanisms for Chinese exporters and overseas investors.
-
Training and Expert Support Will Be Expanded Nationwide
MOFCOM will run national-level training and provide tools, manuals, and digital systems.
Local governments may also hire universities or third-party institutions for compliance assessment.
Why this matters:
Improved professional capacity leads to clearer and more consistent policies.
What This Means Overall for the Trade Business Community
More predictable regulatory environment
Fewer unexpected policy shifts that affect imports, exports, or logistics operations.
Clearer handling of trade frictions
China will respond faster to international concerns and act more actively when Chinese companies face unfair barriers abroad.
Better policy transparency
Written compliance assessments must now accompany every trade-related policy before it is issued.
Long-term benefit for global traders
This aligns China’s internal policymaking more closely with WTO standards.
China is tightening internal controls to ensure all trade policies meet WTO rules, speeding up dispute responses, and strengthening protection for companies involved in international trade.
